    1. Scope

    The following terms of use apply to the use of the content and functions on the www.promotion.edict.de website (hereinafter ‘Portal’) operated by edict egaming GmbH (hereinafter ‘edict’)

    1. User account
      • Registration

    Registration is necessary to use the Portal. During registration, the user must provide their first name and surname, e-mail address and, where applicable, further information that will be requested by edict over the course of the registration process. edict will send the user his/her personal login credentials by e-mail.

    The user has sole responsibility for protecting their login credentials and may not pass this information on to third parties. If the user becomes aware that his/her user account is being improperly used by a third party, he/she shall inform edict of this without delay and undertake to request new login credentials.

    • Deleting a user account

    The user can request to have his/her account deleted at any time. To do so, the user simply needs to send a message to edict indicating that he/she wishes to delete his/her account. When a user account is deleted, all information is permanently deleted after the applicable retention periods established under commercial and tax law have expired.

     

    1. Intellectual property rights/rights of use
      • The trademarks, logos, data, information, images, videos, texts and other content (hereinafter ‘Content’) made available on the Portal are protected by copyright under the German Act on Copyright and Related Rights and/or other laws protecting intellectual property. Any and all intellectual property rights in and to the Content shall remain the exclusive property of edict and/or its licensors.
    • edict makes the Content available for download and grants the user of the Portal non-exclusive rights of use free of charge and limited in time to the duration of the contractual relationship, provided that the user may download the Content and use it exclusively for promotional and marketing purposes. The user may use the Content in advertising and information campaigns that serve the sole and direct purpose of promoting the virtual slot games distributed by edict on the online casino website operated by the user. Furthermore, the Content may be used for promotional purposes in print media and for advertisements in social media campaigns.
    • Copying and adaptation are permitted for the purpose of technical integration of the Content into the online casino website and/or other media in consultation with edict, provided that the Content is not altered. Further editing or modification of the Content in any manner by way of amendments or additions is not permitted. Similarly, the Content may not be disclosed to third parties unless disclosure is demonstrated to be essential to carrying out the user’s promotional activity and edict has given its prior written consent.
    • The user is not permitted to use the Content for promotional and marketing purposes that transgress standards of public decency and/or violate legal bans on advertising or bring edict and/or companies affiliated with it into disrepute.     • edict is entitled to freely withdraw the right of use granted at any time without giving reasons. Upon doing so, the user is no longer authorised to use the Content. All Content downloaded by the user must be deleted and proof thereof provided by the user at edict’s request. The aforementioned shall also apply in the event of termination of the contract.
    1. Provision of Content

    4.1  edict reserves the right to change or remove the Content, in whole or in part, at any time and/or to cease operation of the Portal completely at any time.

    4.2  edict does not make any guarantees with regards to the uninterrupted availability of the Portal. In the event of availability issues, edict will undertake to remedy the malfunctions within its sphere of responsibility without delay.

    1. Liability
      • edict shall not be liable for any direct or indirect losses and/or damage suffered by users arising from the use of the edict Portal and associated with any malfunction in the communication lines, the effects of malware, unlawful actions on the part of third parties aimed at gaining unauthorised access to and/or rendering the edict Portal and/or hardware inoperative, as well as force majeure.
    • edict shall only be liable for damages arising from injury to life, body or health and/or for damages caused intentionally or as a result of gross negligence on the part of edict, its legal representatives or vicarious agents. Furthermore, edict shall only be liable for breach of a material contractual duty due to slight negligence, the fulfilment of which is essential to the proper implementation of the Portal and on the fulfilment of which the user may regularly trust (cardinal obligations), limited to the foreseeable damage typical for this type of contract. The aforementioned limitation of liability applies accordingly to the personal liability of edict’s legal representatives and vicarious agents.
    1. Responsibility for third-party content

    edict does not make any guarantees with regards to the correctness of the Content on third-party sites.

    1. Violations of the terms of use by the user

    In the event of a breach of these terms of use, edict reserves the right to temporarily or permanently suspend and/or delete the user’s account.

    1. Final provisions
      • Changes to the terms of use

    edict reserves the right to update these terms of use from time to time. Users will be notified about the changes. Use of the Portal is governed by the currently valid version of the terms of use.

    • Applicable law/place of jurisdiction

    The laws of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from these terms of use shall be the registered place of business of edict.

    • Severability

    Should individual provisions of these terms of use be and/or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provisions or, in the absence of such a provision, by a provision which the parties would have duly made in good faith if they had been aware of the invalidity of the relevant provision.
